A concrete wall recently fell on and killed a 47-year-old construction worker who had been working at a construction site at a Long Island home.

According to authorities, the worker and two other men had been installing a staircase in a basement apartment that was under renovation in Huntington Station. The workers had built two retaining walls for an outside entrance. When they were in the process of installing steps for the staircase, one of the retaining walls unexpectedly fell and killed one of the workers. Emergency personnel responding to the scene pronounced the man dead at the construction site. Fortunately, the other construction workers did not suffer any injuries.

Hit-And-Run Driver In New York Hits Two Cops, Injures Young Woman

No matter how careful one is on the road, there is always the risk that another driver on the road will act negligently or recklessly and cause a car accident. It bears repeating the obvious: cars, especially at high speeds, can cause serious injuries or even death.

For one reason or another, drivers often forget this concept or blatantly disregard the rules of the road. Hit-and-run drivers can be especially dangerous because they have little compassion for those injured in a car accident or little desire to follow the law. A recent hit-and-run accident in Brooklyn highlights this point. Contacting a Brooklyn personal injury attorney can help answer any questions or concerns you might have regarding your case.

Brooklyn Passenger Killed by Drunk Driver

Accidents caused by drunk drivers

According to the New York Daily News, a passenger in a car was killed early in the morning on August 17th when a drunk driver slammed into the car she was riding in near Crown Heights. As the Altima the passenger was riding in attempted to make a left turn, the driver of a Chevrolet Camaro slammed into the Altima, tearing off its back portion and sending it careening into parked cars. Although the victim was transferred to Kings County Hospital, she was pronounced dead upon arrival. Both drivers were arrested and charged with drunk driving and vehicular manslaughter.

The sad story discussed above unfortunately is all too common on New York City roads, especially late at night. When individuals choose to operate vehicles while intoxicated, they are taking an extreme risk of injuring themselves, their passengers, or the occupants of other vehicles. Such behavior is not only criminal in nature, it is morally reprehensible and can subject the guilty to substantial civil liability should the families of the victims choose to file a lawsuit. If you or someone you love has been injured by a drunk driver, do not hesitate to contact an auto accident lawyer in Brooklyn at the Law Offices of Jeffrey K. Kestenbaum for a free evaluation of your case.

Renewed safety concerns at NYC sites

According to a recent report, a jackhammer chisel flew through a window adjacent to an Asphalt Green construction site that also borders a children’s facility where 400 children play outside daily. Current construction at the site involves the installation of manholes and telecommunications equipment. Although members of the community have urged the company to relocate this work or find a safer alternative, work has continued, and a woman suffered cuts and bruises from shattered glass after the chisel flew through the window.

This incident is yet another example of construction companies failing to adequately protect the safety of the environment surrounding their work. If you or someone you love has been injured in a construction accident, let the Brooklyn construction accident lawyers at the Law Offices of Jeffrey K. Kestenbaum help you understand how you may be able to recover compensation.

Brain Injuries Too Serious to Escape Detection

Posted on July 28, 2014 by

No matter the cause, brain injuries are scary due to their complex character. Further, these types of injuries occur from a vast variety of accidents. Brain injuries also lead to devastating and catastrophic results that can leave victims incapable of working, relaxing, and doing the things they love (such as playing or socializing). They can also lead to significant medical bills and missed time at work or school. And what’s worse is that the signs and symptoms of a brain injury are not always readily apparent, which is what makes these types of injuries so frightening.

If you suspect that you or someone you love has suffered a traumatic brain injury, do not hesitate to seek immediate medical attention. A trained medical professional will evaluate your situation and prescribe the type of care necessary to rehabilitate the injury. However, if you suspect that a doctor or medical professional has made a mistake or failed to use reasonable care in treating you or your loved one’s brain injury, do not hesitate to contact a New York Brain Injury Attorney to help evaluate your case.

Dangers Abound on New York Properties

Posted on May 16, 2014 by

New Yorkers are required to frequent the property of others on a daily basis.  The population density of the United States’ largest city makes it inevitable.  We like to think that the owners of property where we live, work, shop, and seek entertainment are safe and free of avoidable hazards.  The unfortunate reality however, is that dangers lurk around (literally) every corner and down every hallway.  If you or someone you love has been harmed or injured on someone’s property, and believe the owner is in some way responsible, the first step you should take is contacting a Brooklyn Premise Liability Lawyer for a free consultation to help you evaluate your case.

Texting and Driving Leads to Catastrophic Injuries

Posted on May 9, 2014 by

Widely available statistics indicate that there is no safe way to text while driving.  Nevertheless, many people believe they will not get in an accident and continue to engage in this dangerous behavior.  According to a United States Government study, the number of people killed in distraction-affected crashes decreased slightly from 3,360 in 2011 to 3,328 in 2012.  However, an estimated 421,000 people were injured in motor vehicle crashes involving a distracted driver.  This is a staggering number that is far too high.  If you or a loved one has been injured in an accident where you believe the driver was sending text messages while driving, an experienced New York auto accident attorney can answer any questions or concerns you may have regarding your case.

Why is Texting and Driving So Dangerous?

Simply stated, distracted driving diverts the driver’s attention away from the primary objective of operating the vehicle in a manner that is safe to him or her and other motorists and pedestrians.  All such distractions are very dangerous, and pose risks to the safety of motorists, pedestrians, and bystanders in the vicinity of the texting driver.

Why is the TLC Not Firing Dangerous Cab Drivers?

Posted on March 26, 2014 by

In years past, the New York City Taxi and Limousine Commission vigorously policed its drivers. The TLC investigated any accusations of reckless driving and prosecuted those individuals when it was warranted. This led to license revocations and suspensions even if the driver was not subject to these disciplinary actions in the court system. Seeking legal guidance from a knowledgeable personal injury attorney in New York can help clear up any confusion or concerns you might have regarding your case.

The TLC’s new way of doing things had the effect of removing dangerous drivers after just one event. For example, two cab drivers were involved in a serious collision in 1998 that left one victim with an amputated leg and another with very serious injuries. The TLC reacted quickly and suspended and then revoked the at-fault driver’s license.

Haste costs lives on the Upper West Side

Posted on February 28, 2014 by

New Yorkers want to get wherever they are going at maximum speed regardless of the risk involved. This is the city where the word “wait” has become an objectionable four letter word. We have more to accomplish in a shorter period of time than any other civilization since the Pharaohs built their pyramids. Make sure to talk to a qualified personal injury attorney in Brooklyn if you have any questions or concerns regarding the accident and next legal steps to take.

However, in our haste to save a minute here or a minute there, we put our lives at risk. A doctor was the third person killed in the beginning of the year on the Upper West Side on 96th Street in Manhattan. The tragedy occurred on Sunday, January 19, 2014. Columbia University Medical Center anesthesiology resident Samantha Lee, 26, was hit by an ambulance‘s mirror in front of her apartment building on 96th Street between Broadway and West End Avenue. Police reported that Lee was crossing the street around the middle of the block at 4:45 AM and was hit by the driver’s side mirror of an ambulance from the St. Luke’s Hospital that was westbound. The physician fell and landed face down on the eastbound lanes. She was subsequently run over by a red 4 Dodge Charger, according to officials. The young woman was declared dead at the scene and neither driver was charged.
