Texting and Driving Leads to Catastrophic Injuries

Posted on May 9, 2014 by

Widely available statistics indicate that there is no safe way to text while driving.  Nevertheless, many people believe they will not get in an accident and continue to engage in this dangerous behavior.  According to a United States Government study, the number of people killed in distraction-affected crashes decreased slightly from 3,360 in 2011 to 3,328 in 2012.  However, an estimated 421,000 people were injured in motor vehicle crashes involving a distracted driver.  This is a staggering number that is far too high.  If you or a loved one has been injured in an accident where you believe the driver was sending text messages while driving, an experienced New York auto accident attorney can answer any questions or concerns you may have regarding your case.

Why is Texting and Driving So Dangerous?

Simply stated, distracted driving diverts the driver’s attention away from the primary objective of operating the vehicle in a manner that is safe to him or her and other motorists and pedestrians.  All such distractions are very dangerous, and pose risks to the safety of motorists, pedestrians, and bystanders in the vicinity of the texting driver.

Massive Explosion Serves as Reminder that Dangers are Lurking

On March 13, 2014 a gas leak triggered a massive explosion in East Harlem, causing two five-story apartment buildings to collapse. The relatives of one of the victims recently filed a $10 million wrongful death lawsuit against the City.  Such an accident serves as a reminder that anything can and may happen at any time.  If a loved one is ever involved in an incident that leads to death, an experienced Brooklyn wrongful death attorney can answer any questions or concerns you may have regarding your case.

What is Considered Wrongful Death in New York?

Wrongful death, such as death from an accident or incident like the one described above, is defined as a death that is caused by the wrongful act or negligence of another. Such acts serve as the basis for a civil action for damages on behalf of the decedent’s heirs.  The New York State Constitution’s Estate and Powers Trust law provides the basis for New York’s wrongful death statute.  It allows a decedent’s heir or representative to sue for whatever amount of money damages on behalf of a person or persons who could recover under the estate.

British Woman Injured in Taxicab Accident Now Suing City

Posted on April 8, 2014 by

According to news sources, a 24-year old British woman who lost her leg in a gruesome midtown car accident in August, 2013, announced late last year that she is suing the City of New York for $27.5 million.

Sian Green and her family were dismayed when the Manhattan District Attorney’s Office announced in November 2013, that there would be no criminal charges filed against the taxicab driver who hit Green, due to a lack of evidence that the driver intended to hit the victim.  Sian Green maintains that Himon’s gross negligence caused the accident.  In addition, her lawsuit alleges that the New York  City Taxi and Limousine Commission should have suspended Faysal Himon’s driver’s license before he caused the accident that resulted in the loss of her leg.  Before the accident that injured Green, Faysal Himon had been charged with seven traffic violations and had acquired seven points on his license.  Himon’s history of reckless driving should have resulted in the loss of his driver’s license, but a computer glitch prevented the Taxi and Limousine Commission from responding to Himon’s dangerous driving record and suspending his license.

$15 Million Lawsuit Filed Against Citi Bike

Posted on March 7, 2014 by

New York City has several techniques in place to encourage people to commute via bicycle in order to reduce the strain on traffic clogged streets. According to the New York City Department of Transportation, these efforts have led to an average of 45,300 people utilizing their bikes as opposed to other commuting options during the summer months. Unfortunately, a rise in cyclists also means increased injuries, including the more than 4,200 people who were hurt on a bike in 2012. A recent lawsuit that has been filed by Ronald Corwin alleges that he was the victim of one of these injuries, and he is blaming the city and Citi Bike for the fact that he is now suffering from a permanent case of traumatic nerve palsy.

Taxi Accident Victim to Sue City

Posted on December 18, 2013 by

New York may have more mass transit options compared to other cities, but particularly in Manhattan, a significant amount of travel is done in the taxicabs that have become synonymous with the City. And while the vast majority of taxi cab travel occurs without incident, some taxi trips can turn tragic. New Yorkers witnessed how grave the damage can be on August 20th, when a taxi jumped a curb and collided with a woman near Rockefeller Center, causing her to lose her left leg. Now, the woman — Sian Green, a 25-year-old visitor from Great Britain, plans to sue the City of New York, alleging the taxi driver should not have been permitted to drive a cab. Auto accidents are nothing new in New York City. However, the incident that caused the accident included a bicycle messenger with a long history of arrests and a taxi driver with several moving violations and an accident on his record. The question that only the courts can decide is: was the City negligent in issuing a taxi license to a driver with a bad safety record? If you find yourself in a situation involving an auto accident, contact a New York accident attorney that will fight to obtain a full and maximum settlement for you.

According to the woman’s attorney, the taxi cab driver at fault in the incident — Mohammed Faysal Himon, 24 — had seven points on his license and demonstrated a failure to keep pedestrians safe. A computer glitch in the Taxi and Limousine Commission’s system apparently allowed Himon to maintain his license, which ended up being a tragic mistake. Himon was driving near Rockefeller Center when he began jockeying for position with a bike messenger. Himon then lost control of the cab, causing it to lurch over the curb and collide violently with Green. In addition to losing her left leg, Green has severe nerve damage in her right leg and suffered a traumatic brain injury.
